Terrorism

Terrorism as a phenomenon is essentially a very simple thing that can be dealt with if you answer the question “why.”

With terrorism the situation is even worse than with the definition of fascism. At the moment, at the level of laws, there is no single concept of what terrorism is as a systematized, organized illegal activity. The classification of crimes of a terrorist nature is made according to a set of characteristics defined for certain types of crimes. This problem exists not only at the level of local law, but also at the level of international sources of law. Individual crimes are defined in state laws and existing international conventions. Terrorist activity in the conventions means what is described in the law. Consequently, terrorist acts and terrorist activities of a different nature, which are essentially terrorist, but are not described in the laws - that is, there was no precedent for anyone being punished for this - are directly decriminalized by such anti-terrorism laws. The problem of legal regulation of anti-terrorism activities lies in one thing - investigative errors, due to which the entire corpus delicti of terrorist acts committed is not revealed in its entirety. As soon as the definition of terrorism is broken down into its component parts in laws, it becomes unrecognizable, and therefore crimes of a terrorist nature are not classified in their entirety. This loophole is used by both criminals and law enforcement officers. According to the Convention for the Suppression of the Financing of Terrorism, it is automatically decriminalized upon the outbreak of hostilities. And war crimes of a similar nature had already been decriminalized. The conclusion that follows directly from the text of this Convention is that war is an excuse for terrorist acts.

Current Recognition of Terrorism

A qualifying feature for all terrorist acts without exception is the statement of any specific demands by terrorists, the explicit communication of a terrorist act as entirely in the name of some ideological goal, or the assumption of responsibility for its commission by any terrorist organization.

Like fascism, the scale of terrorism and its true goals extend far beyond the limits of the concepts given in the law and individual sentences.

Not prohibited means allowed.

The Convention states, that terrorism is "An act which constitutes an offense within the scope of and as defined in one of the treaties listed in the annex, or any other act intended to cause death or serious bodily injury to a civilian, or to any other person not taking an active part in the hostilities in a situation of armed conflict, when the purpose of such act, by its nature or context, is to intimidate a population, or to compel a government or an international organization to do or to abstain from doing any act." For this reason, the definition given in the Convention, and replicated in a variety of by-laws and local laws of state parties, does not allow the defeat of terrorism. It is impossible to defeat by law what is not described by law.

Hijacking and hijacking of airplanes, mass shootings, hostage-taking, house explosions, arson, explosions, poisonings, spreading viruses - all these crimes that are associated with terrorist activities are technically complex, requiring special training, infrastructure, special equipment, weapons, and financial resources. The definition of terrorism.

Terrorism is a professionally organized criminal activity committed by an organized criminal community, usually of a ritual nature, associated with the use of weapons or public unrest, mass infliction of harm to health or mass killing of people and animals, or particularly large-scale property damage, or especially large-scale damage to the reputation of government officials and public figures, influential persons and organizations, undermining the authority of official government. The goal of terrorism is to achieve the communication, economic, political, social, and ideological goals of an organized criminal community.

Inconsistency.

What separates a terrorist act from any other crime, even a particularly serious one? First of all, this is the extensive nature of the harm caused, the massive number of victims, the seriousness of the damage, the great public outcry, and the impudence of the crime committed. If all these signs are present, but there is no direct message to the authorities from an organization recognized as terrorist, the crime will be erroneously classified as an accident, negligence, causing harm by negligence, and other insignificant articles from the point of view of the crime. In extreme cases, like with cases of the Columbine category, it’s like a mass murder. But there are several more distinctive features that characterize crimes falling under the category of terrorism, not defined in the law. The commission of any terrorist act is ritual in nature. By choosing the location of a terrorist act, time, circumstances, method of committing a terrorist act, the composition of a group of terrorists, their names, and other circumstances, criminals communicate the true goals of committing a terrorist act and the meta-message that they want to convey to the recipient. A fatal mistake in classifying terrorist crimes is to interpret them as conveying messages only to state leaders as a method of blackmail to achieve some criminal goals. The recipient of the meta-message terrorists convey through a terrorist attack is a much broader group of people than one might assume. The main thing that is a distinctive feature of any terrorist crime is the discrepancy between the complexity and degree of preparation of the terrorist act, as well as the mandatory ritual staging of the terrorist act itself, with the stated demands of the terrorists, or the absence in principle of any stated requirements. Thus, to differentiate a terrorist crime from any other type of homicide - of which, oddly enough, if we single out all the crimes of a terrorist nature and the crimes of the 3rd Reich, there are not so many left - there is a completely different specific set of signs.

What is the problem with the crime described in the laws and classified as “terrorism”? It is necessary to remove only 2 qualifying criteria, and the problem in defining what terrorism is will disappear. The first is the misconception that a terrorist act necessarily involves the public making of some claim or assumption of responsibility for the terrorist act by some criminal organization. The second is death or harm to ordinary civilians. By removing these two signs, and analyzing all major, ridiculous, or high-profile crimes for the presence of key features of terrorist crimes, the full picture will be restored. And with it it will become much easier to identify the customer, organizer, and all performers of this activity.

Terrorist acts are indeed a way of communication. The History of Criminal Language

The underworld speaks a completely different language, which is understood only by those who are part of it from one side or the other. This language often consists of many words from ordinary vocabulary, but they have a different meaning. To an outsider, communicating in this language is gibberish. One way to communicate in criminal language is to send a marked text with a key. Markings highlight words or letters that should be read or skipped.
